New York Child Support


Every child has the right to get the guidance, the love and support of their parents. If the parents don’t live together, then the parent with whom the child lives is called the custodial parent and the other as the non-custodial. It is important that the non-custodial parent to pay for the child’s support to the other parent. The New York Child Support State authority has also set several laws for child-support.

The basic law says that the non-custodial parent must pay 17% of her or his income for one child, 25% for two children, 29% for three children, and higher. The income here is referred as their gross salary or the income from self employment, income from sale of assets, investments etc. Few things are deducted from the sum of income like the local taxes, medical and social security payments and the end result is multiplied by the appropriate percentage above which is the basic child-support amount.

Along with the basic amount the non-custodial parent can be asked to pay for the extra expenses of the child, which in law terms are called “add-ons”. These may include important ones like, child care, tuition, clothing, medical expenses and other things which are not included in the insurances like the games, computers, trips, and music or sports activities.  The court decides the total parental income and the percentage of the total each has to pay. The cost of add-ons is decided by using that percentage.

The parent with whom the child stays for more than the 50% of the court allotted time period, is considered as the custodial parent. If the time spent is same for both the parents then the parent with a higher income is considered as the non-custodial parent and he/ she has to pay for the child-support. Some child expenses can be discrete like the cost of clothing and toys which the child will only use.

Other expenses are taken care of by the family, like the cost on food. Also there could be many changes in the couples’ lives after divorce, but the New York State authorities is strong that the child should not punished for what happened between their parents. He/she should be given the same atmosphere as it was before the divorce, in relation to his/her surroundings, the home structure etc.
